On October 14, 2021, Matthew Galati appeared on The Mobility Standard, a podcast hosted by Investment Migration Insider (IMI). Matt opined on various open-ended questions the immigration community has been asking, such as what the future of the EB-5 Regional Center Program looks like, the likelihood of reauthorization or investment price changes, his drive behind suing federal agencies, and why the mandamus route has been such a hot topic for current investors, immigrants and their petitioners, and other immigration attorneys to consider. Because the Trump Administration took active measures to slow down the awarding of immigration benefits—and the Biden Administration has been (at best) apathetic about ameliorating such delays—filing lawsuits against federal agencies has become a favored option for many. As Matt indicated in the podcast episode, in his experience, lawsuits tend to produce tangible results. Specifically, Matt tells the episode listeners of the recent victory from the Gutta v. Renaud, 2021 WL 533757, 4:20-cv-06579-DMR (N.D. Cal.), where USCIS settled the case, resulting in all 22 plaintiffs’ I-526 petitions in being adjudicated before the June 30, 2021 Regional Center sunset. This was especially groundbreaking in hindsight because of the eventual expiration and ongoing program lapse, which would have negatively affected the adjudication of the subject petitions in that case.
